Terms of sale

General Terms and Conditions of Sale
1. Seller
These general terms and conditions of sale (the "Terms") govern all sales concluded on this website between Hexagone Horlogerie, a French SAS (simplified joint-stock company) with share capital of €50,000, registered with the Avignon Trade and Companies Register under number 908 244 379, whose registered office is located at avenue de la Rode, 84500 Bollène, France, EU VAT number FR45908244379, operating the brand Julien Louis (the "Seller"), and any person making a purchase on the website (the "Customer"). Placing an order implies full acceptance of the Terms in force on the date of the order.
2. Products
The Seller offers watches made and assembled by hand in France, some of which can be configured (colour, pattern, strap) and others of which are unique pieces. Photographs and renderings are as accurate as possible; slight variations in shade or finish, inherent to handcrafted work, do not constitute a lack of conformity.
3. Prices
Prices are shown inclusive of all taxes. For deliveries within the European Union, VAT is included in the displayed price. For deliveries outside the European Union, import duties and taxes are, where possible, calculated and charged at the time of order. Prices displayed in a currency other than the euro are converted automatically; the amount charged is the one shown at checkout. Shipping costs, where applicable, depend on the collection and the destination; they are detailed in the Shipping Policy and shown before the order is confirmed. The Seller reserves the right to change its prices at any time; the applicable price is the one displayed when the order is confirmed.
4. Orders
The Customer selects the watch and its options, checks the order summary, then confirms the order and proceeds to payment. A confirmation email summarising the order is sent to the Customer. The Seller reserves the right to cancel any order in the event of a prior dispute, suspected fraud or an obvious pricing error, in which case the Customer is refunded in full.
5. Payment
Payment is due at the time of order and is made online, securely, using the payment methods offered at checkout. The order is only processed once payment has been confirmed.
6. Manufacturing and delivery
Each watch is made to order within 4 to 12 weeks (30 to 45 days on average) from confirmation of payment; an estimated delivery date is communicated to the Customer. Shipping methods and transit times are set out in the Shipping Policy. If the delivery date is exceeded, the Customer may, after asking the Seller to deliver within a reasonable additional period, terminate the contract and obtain a full refund of the sums paid, in accordance with Articles L216-6 et seq. of the French Consumer Code.
7. Transfer of ownership and risk
Ownership passes upon full payment of the price. The risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer, takes physical possession of the watch.
8. Right of withdrawal
Consumer Customers have 14 days from receipt to exercise their right of withdrawal, under the conditions and exceptions described in the Return and Refund Policy, which forms an integral part of these Terms.
9. Legal guarantees
Consumer Customers benefit from the legal guarantee of conformity for 2 years from delivery of the goods (Articles L217-3 to L217-20 of the French Consumer Code): they may obtain repair or replacement of the goods or, failing that, a price reduction or termination of the contract, and are not required to prove the existence of the defect during this period. They also benefit from the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). These guarantees do not cover normal wear and tear, impacts, immersion beyond the stated water resistance, or work carried out by an unauthorised third party. 10. Liability
The Seller cannot be held liable for non-performance of the contract due to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure.
11. Personal data
The data collected is necessary to process orders and is handled in accordance with the website's Privacy Policy. The Customer has the right to access, rectify, erase and object to the processing of their data, which can be exercised by writing to contact@julienlouis.com.
12. Intellectual property
The Julien Louis brand and the creations, designs, photographs and content of the website are the exclusive property of the Seller. Any reproduction without authorisation is prohibited.
13. Mediation and disputes
In the event of a complaint, the Customer is invited to contact the Seller first at contact@julienlouis.com in order to seek an amicable solution. Failing that, Consumer Customers may refer the matter free of charge to the consumer mediator to which the Seller belongs: CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France – www.cm2c.net (online referral via the website).
14. Governing law
These Terms are governed by French law, without prejudice to any more protective mandatory provisions of the law of the Consumer Customer's country of habitual residence. Failing an amicable settlement, the competent courts are those designated by law.
